Drake Law School Dean Jerry Anderson asks us to consider whether our current emphasis on a landowner’s right to exclude others is unduly impeding the public’s freedom to travel. He contrasts the American version of private property rights with the British “Right to Roam” which allows the public to wander freely over privately owned land such as mountains, moors, heath, and downs. In Sweden, the Allemansratt similarly allows public access to private land for hiking, camping and collecting berries and mushrooms. Dean Anderson asks whether a modified right to exclude would work in the United States and still serve the values behind private property protection. Could or should there be an American right to roam?
