Risk of Harm: Ethical Considerations in Mental Health Care

Training Summary:

Clients at risk of harming themselves or others create some of the most intense stress for professionals working in mental health care. Understanding your responsibilities as well as your options will allow you to minimize your stress level and provide better care to your clients. This educational presentation will provide a review of the legal and ethical principles related to clients’ risk of harm to self and others. We will review several sources that influence our ethical and legal decision-making as it relates to risk of suicidal and homicidal behavior. Participants can expect to gain a better understanding of the requirements under HIPAA, state law and administrative rules, Codes of Ethics, as well as the impact of case law in the United States. As required by the Board of Social Work to meet the requirements for Ethics CEUs, this presentation will include a review of relevant information from the Social Work Code of Ethics. 

Learning Objectives:

1) Participants will increase their knowledge of the legal and ethical principles that inform decision-making and actions as mental health professionals. 
2) Participants will learn strategies for assessing and managing clients at risk of suicide and homicide. Strategies will include ways to decrease your legal risk while simultaneously providing excellent care to your clients and adhering to ethical principles. 
3) Participants will gain knowledge of the mental health commitment process. 
4) Participants will be able to consider alternatives to hospitalization for at risk clients. 
5) Participants will be able to apply the principles of ‘Duty to Warn’ doctrine in their professional practice. 
6) Participants will improve their ability to resolve ethical dilemmas by utilizing an ethical decision-making model.

About the Presenter:

Wade Kuehl, MSW, LISW, has 26 years of experience working in mental health care and is currently the Director of Psychological Health at the 185th Air Refueling Wing in Sioux City, Iowa. He has previously served as the Director of Behavioral Health at Mercy Medical Center, and as the Clinical Director at Siouxland Mental Health Center, both also in Sioux City, Iowa. Kuehl earned a B.S. in Psychology and Criminal Justice in 1993 and a Masters in Social Work in 2000.
